Terms and Conditions

GENERAL
1 Definitions:” The Company” means S W M Ltd, trading as Spectrum Fire Protection “The Buyer” means the person, firm or company, ordering or buying the goods from the company. “The Goods” means the products, service or subject matter of the relevant order of sale.
2 The company reserves the right to reject any order received for goods. Any order received that amends these terms is subject to written acceptance by the company.
PRICE
3 Prices quoted by the company are valid for 30 days..
4 The company reserves the right to charge for delivery of goods.
PAYMENT & TITLE
5 The goods remain the property of the company until all payments relating to the goods have been cleared. Full payment is due no later than 20 days after the date of invoice. If full payment has not been received within 20 days, the company reserves the right to instruct the county court to issue a summons for full recovery, the cost of which will be borne by the buyer.
6 The buyer agrees that the company or its representatives may enter the buyers premises at any reasonable time in order to recover goods originally supplied by the company for which payment is outstanding beyond any previously written and agreed credit term.
PRODUCTS
7 All products, unless otherwise stated, supplied by the company are supplied with a one year warranty. Defective goods may be returned to the company at the buyers expense, and the company may replace, issue a credit note or repair the goods at the company’s discretion within a specified time period. The company is not responsible for goods returned to the company that are lost or further damaged in transit.
8 Defective goods returned under clause 7 must be returned with a copy of original invoice and in a clean and reasonable condition. Goods returned otherwise will, at the company’s discretion, either be refused or subject to a fee to cover our expense.
DELIVERY
9 The company will make its best endeavors to deliver all goods as instructed by the buyer. The company will not be responsible for any late deliveries however caused.
10 The buyer shall inspect all goods immediately they are delivered. The company reserves the right to reject claims for incorrect delivery 24 hours after the due date for delivery.
SERVICING
11 In agreeing to allow the company to carry out servicing of appliances/products, annual or otherwise, the buyer enters into a contract with the company. This contract may be terminated by the company at any time without notice or by the buyer, in writing, not less than three calendar months before the relevant servicing is due. If such notice is not given by the buyer the company reserves the right to charge the buyer termination fees of £5 per extinguisher plus the service visit charge.
FORCE MAJEURE
12 The company reserves the right to cancel, suspend or vary the operation of contract of sale if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing) fire, flood, storms, plant breakdown, strikes, lock outs, riot, hostilities, non-availability of material or suppliers or any other event outside the control of the company; and the company shall not be held liable for any breach of contract resulting from such events.
